Section 6.01. Site plan required.

Approval of a planned development site plan by city council shall be a prerequisite to the submittal of any final plat for a subdivision of land resulting from a planned development.

Section 6.02. Site plan submittal.

Planned development site plans shall be submitted to the zoning administrator for review in accordance with the zoning ordinance.

Section 6.03. Installation of improvements.

1. Installation or guarantee required. Approval of the final plat shall be subject to the developer having installed the site improvements designated on the approved planned development site plan or having guaranteed, to the satisfaction of the city, the installation of said improvements. Property may be developed in phases if clearly indicated on the approved site plan.

No building permit for any residential dwelling shall be issued by the city unless and until a final plat for a recognized phase of development has been approved by the city council and duly recorded on the records of Rowan County.

2. Guarantee of improvements. Where the required improvements have not been completed prior to the submission of the plat for final approval, the approval of said plat shall be subject to the subdivider guaranteeing the installation of the improvements in one of the following methods:

a. Filing a performance of surety bond in an amount to be determined by the subdivision administrator. The amount shall be within ten (10) percent of the city's estimated cost of construction, but in no case shall be less that five thousand dollars ($5,000.00).

b. Depositing or placing in escrow a certified check orcash in an amount to be determined by the subdivision administrator as noted above. Portions of the security deposit may be released as work progresses.

Section 6.04. Final plat.

1. Final plat submittal. The procedure for obtaining plat approval is as follows:

a. The subdivider shall submit the original and two (2) copies of the final plat to the subdivision administrator. There shall be no fee for this submittal.

b. The final plat shall be in conformity with the approved planned development site plan.

c. Approval of the final plat shall be subject to the developer having installed site improvements in accordance with the approved planned development site plan or having guaranteed the installation of improvements in accordance with section 6.03.2 of this ordinance.

d. The final plat shall be properly signed and executed as required for recording by the Register of Deeds of Rowan County.

e. Final plats submitted at least eight (8) business days prior to the next regularly scheduled city council meeting and found to be in conformance with the standards of this ordinance shall be transmitted with comments and recommendations to council.

f. Action of the city council shall be noted on the original mylar tracing of the final plat. One (1) print and the original plat shall be returned to the subdivider, and one print shall be filed with the subdivision administrator.

2. Final plat requirements. The final plat shall be at the scale required by the Register of Deeds of Rowan County and shall conform substantially to the approved planned development site plan. The final plat may constitute a limited phase of the approved site plan provided, however, that such phase is clearly designated on the approved site plan. The final plat shall be prepared on mylar by a registered surveyor and shall show the following information:

a. The lines of all street rights-of-way and street names.

b. Lot lines and lot numbers.

c. The existing zoning classification and a note identifying minimum building setback lines for such zoning.

d. A note clearly identifying whether "out-parcels" will be allowed additional driveway cuts on public streets and/or access through common areas and parking lots.

e. A note clearly identifying the status and maintenance responsibility for any private street, water line, or sewer line.

f. Reservations, sight triangles, easements, and any areas to be dedicated to public use or sites for other than residential use with notes stating their purposes and any limitations.

g. Drainage easements in accordance with the adopted Uniform Construction Standards of the City of Salisbury.

h. Buffer areas, floodplain information, National Register of Historic Places designation, or any other conditions affecting the site.

i. Sufficient data to determine readily and reproduce on the ground the location, bearing and length of every street line, lot line, boundary line, block line and building line, whether curved or straight, and including true north point or North Carolina State Grid North. This should include the radius, central angle, point of tangent, tangent distance and arcs and chords of all curved streets and curved property lines.

j. All property line dimensions should be to the nearest hundredth of a foot and angles to the nearest minute.

k. Accurate location and description of all monuments and markers.

l. The names and locations of adjoining subdivisions and streets, and the location and ownership of adjoining unsubdivided property.

m. Title, date, name and location of subdivision, and graphic scale.

n. Name of subdivider, engineer, surveyor and/or land planner.

o. Utility easements.

p. Forms for final certifications: The following certificates shall be affixed to the final plat in such a manner as to insure that said certificates will be legible on any prints made therefrom:

(1) Certificate of ownership and dedication:

I (We) hereby certify that I am (we are) the owner(s) of the property shown and described hereon and that I (we) hereby adopt this plan of subdivision with my (our) free consent, establish minimum building lines, and dedicate all streets, alleys, walks, parks, and other sites to public or private use as noted. Further, I (we) certify the land as shown hereon is within the platting jurisdiction of the City of Salisbury.

(2) Certificate of the approval of the installation and construction of streets, utilities and other required improvements:

I hereby certify: (1) that streets, utilities and other improvements of this subdivision, if required, have been installed in substantial conformance with City specifications and standards or, (2) that a guarantee of the installation of the required improvements in an amount or manner satisfactory to the City of Salisbury has been received.

(4) Certificate of approval for recording plat and acceptance of dedications:

I do hereby certify that on the ________ day of ________, 19________, the City Council of the City of Salisbury approved this plat for recording and accepted the dedication of the streets, easements, rights-of-way and public parks and other sites for public purposes as shown hereon, but assume no responsibility to open or maintain the same until, in the opinion of the governing body of the City of Salisbury, it is in the public interest to do so.
