ARTICLE II. DEFINITION OF TERMS

 

Section 2.01. Definitions.

For the purpose of this ordinance, certain words or terms used herein shall be defined as follows:

1. Subdivision: A "subdivision" shall include all divisions of a tract or parcel of land into two (2) or more lots, building sites, or other divisions for the purposes of sale or building development (whether immediate or future) and shall include all division of land involving the dedication of a new street or a change in existing streets.

2. Exception plat subdivision: For the purposes of these regulations, an exception plat subdivision will be reviewed and approved in accordance with Article III and must meet one of the following conditions:

(a) The combination or recombination of portions of previously subdivided and recorded lots where the total number of lots is not increased and the resultant lots are equal to or exceed the standards of the city as required by this ordinance;

(b) The division of land into greater than ten (10) acres where no street right-of-way dedication is involved;

(c) The public acquisition by purchase of strips of land for the widening or opening of streets; or

(d) The division of a tract in single ownership whose entire area is no greater that two (2) acres into not more than three (3) lots, where no street right-of-way dedication is involved and where the resultant lots are equal to or exceed the standards of the municipality as required by this ordinance.

3. Minor plat subdivision: For the purposes of these regulations, a minor plat subdivision will be reviewed and approved in accordance with Article IV and is defined as a subdivision:

(a) Involving not more than four (4) lots fronting on an existing approved street; and

(b) Not involving any new street or prospectively requiring any new street for access to interior property; and

(c) Not requiring extension of public sewage or water lines to serve properties at the rear; and

(d) Creating no new or residual parcels not conforming to the requirements of these regulations and related ordinances; and

(e) Not being located partially or entirely within a WS-IV-PA (Watershed) Zoning overlay.

4. Conventional subdivision: For the purposes of these regulations, a conventional subdivision is a subdivision that does not qualify for another review process and will be reviewed and approved in accordance with Article V.

5. Planned development: For the purposes of these regulations, a planned development is a development which is required to have a site plan approved by city council in accordance with the Zoning Ordinance procedures for either RD-A Zoning, RD-B Zoning, or group developments. Planned developments which include the subdivision of property are required to record a final plat which will be reviewed and approved in accordance with Article VI of this ordinance.

6. Alley: A strip of land, owned publicly or privately, set aside primarily for vehicular service access to the back or side of properties otherwise abutting on a street.

7. Building setback line: A line parallel to the front property line in front of which no structure shall be erected.

8. City: The City of Salisbury, North Carolina.

9. City council: City council of the City of Salisbury, North Carolina.

10. Easement: A grant by the property owner for use by the public, a corporation, or person(s) of a strip of land for specified purpose. All newly created easements must be in a form suitable for recording, preferably as part of the final plat.

11. Engineering drawings: Plans, profiles, and associated documentation of all proposed street, drainage, water and sewer improvements, prepared in accordance with the Uniform Construction Standards Manual.

12. Extraterritorial jurisdiction: That land lying beyond the municipal limits of the City of Salisbury and within the extraterritorial jurisdiction boundary as delineated on the official zoning map of the City of Salisbury in accordance with G.S. 160A-360.

13. Lot: A portion of a subdivision or any other parcel of land intended as a unit for transfer of ownership or for development or both. The word "lot" includes the word "plot" or "parcel."

(a) Double-frontage: A lot of the same depth as the width of a block containing two (2) tiers of lots and which is accessible from both of the streets upon which it fronts.

(b) Single-tier: A lot which backs upon limited access highway, a railroad, a physical barrier, or a nonresidential use and to which access from the rear is usually prohibited.

(c) Corner lot: A lot which has continuous frontage at two (2) intersecting streets.

(d) Pipestem lot (also known as flag lot or panhandle lot): A lot which contains a relatively narrow strip that provides street access.

14. Map for recordation: A plat that depicts existing property where the act of subdivision is not involved.

15. Official maps or plans: Any maps or plans officially adopted by the city council as a guide for the development of the city and surrounding area.

16. Planning board: The City of Salisbury Planning Board.

17. Preliminary plat: A draft plat of a proposed subdivision, used to determine if the proposed development is in general conformance with city standards and ordinances.

18. Street: A dedicated and accepted public right-of-way for vehicular traffic.

(a) Thoroughfares: Thoroughfares are those streets which generally serve through-traffic and are designated on the current edition of the officially adopted Salisbury Area Thoroughfare Plan. Thoroughfares may be further defined as major thoroughfares or minor thoroughfares.

(b) Local street: A local street is any link not a higher-order urban system and serves primarily to provide direct access to abutting property.

(c) Cul-de-sac: A cul-de-sac is a short street having but one (1) end open to traffic and the other end being permanently terminated and a vehicular turnaround provided.

(d) Frontage road: A frontage road is a local street or road that is parallel to a full or partial access controlled facility and functions to provide access to adjacent land.

19. Subdivider: Any person, firm or corporation who subdivides or develops any land deemed to be a subdivision as herein defined.

20. Uniform Construction Standards: The construction standards which are contained in the current edition of the manual which has been officially adopted by the city council as a written document of city construction standards.
